I am going to apply for FAFSA financial aid but parent doesn't file taxes.?

I have a single parent who is self employed. My father does masonry work and makes probably 9,000$ a year and doesn't file taxes. Am I going to be in trouble for when I apply for FAFSA because he doesn't file taxes? Isn't he legally exempt from paying taxes? What are my options, can anyone help me out?
